Ideologia e Direito: Duplo vínculo como estruturante jurídico-social

No presente artigo, trabalha-se fundamentalmente com os conceitos desenvolvidos por Slavoj Žižek no que diz respeito à "paixão pelo Real", no sentido de compreender o próprio capitalismo enquanto fundador de uma ideologia que se encontra inserida em outros espaços, mormente o da política, em prol da produção de uma "ausência" do Evento messiânico benjaminiano. Em seguida, correlaciona-se tal ideologia, enquanto embasamento subjacente da estrutura jurídica de poder, com a teoria do jus-humanismo normativo, que se estabelece principalmente na esfera do discurso enquanto aguarda a destituição da significação mantenedora de um status quo político, jurídico, social, econômico e cultural. Para tanto, traz-se o conceito de duplo vínculo, inicialmente da psicologia, por se perceber como extremamente válido para a compreensão do antagonismo existente entre discurso e práticas jurídicas.

In this article, we work fundamentally with the concepts developed by Slavoj Žižek in regards to the "passion for the Real" to apprehend capitalism itself as founder of an ideology which is inserted in other spaces, mostly the political, in behalf of the production of an "absence" of the benjaminian messianic Event. Subsequently, we correlate such ideology, as underlying basis of the juridical structure of power, with the normative jus-humanism theory, which establishes itself mostly in the discourse as it awaits the destitution of a political, juridic, social, economical and cultural status quo meaning supporter. To achieve it, we bring the concept, initially from psychology, of double bind, as we realized how extremely valid it is for the comprehension of the existing antagonism between discourse and legal practice.
